These Terms and Conditions (the "Terms") are a legal agreement between Medevc LLC ("Medevc", "we", "us", or "our") and any person or entity who accesses or uses our websites, plugins, and related services that power the AI chatbot (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Who may use the Service
You must be at least the age of majority in your place of residence (or have verifiable parental consent) and have the legal capacity to enter into these Terms.
If you use the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms. The words "you" and "your" include the entity.
3. Your account and security
- You are responsible for keeping your Account credentials secure.
- You must promptly notify us if you suspect unauthorized use of your Account.
- You are responsible for all activity that occurs under your Account, except to the extent caused by our breach of these Terms.
4. The Service
The Service provides an AI‑powered chatbot and related tools for information, assistance, and automation.
Features may change from time to time. We may add, remove, or modify features, impose or adjust limits (e.g., rate limits, storage, or conversation history), and provide beta or experimental features.
Non‑advisory use: Unless expressly stated, the Service does not provide legal, medical, financial, or other professional advice. You are solely responsible for evaluating AI Output and for your decisions based on it.
5. Acceptable Use
You agree that you will not:
- Violate any applicable laws or regulations;
- Use the Service to develop or disseminate malware, spam, or content that is illegal, infringing, defamatory, harassing, deceptive, hateful, or harmful;
- Attempt to reverse engineer, decompile, or otherwise extract source code from the Service or underlying models, except where permitted by law;
- Bypass or circumvent any access controls, rate limits, or usage restrictions;
- Misrepresent your identity or the origin of your prompts or outputs;
- Use the Service to collect or process sensitive personal data unless you have a lawful basis and necessary safeguards;
- Use the Service for high‑risk activities where errors could lead to death, personal injury, or severe environmental or property damage;
- Interfere with or disrupt the Service, servers, or networks;
- Submit content or inputs you do not have the right to use, or that violate third‑party rights (including privacy, publicity, or intellectual property rights);
- Use automated means to access the Service beyond documented APIs or in violation of published rate limits.
We reserve the right to suspend or terminate Accounts or throttle usage that violates this section.
6. Your Content and AI Output
Ownership of User Content: You retain ownership of your User Content. You grant Medevc a worldwide, non‑exclusive, royalty‑free license to host, process, transmit, display, and use your User Content as necessary to provide and improve the Service, and to comply with law.
AI Output: Subject to third‑party rights and applicable law, we grant you a non‑exclusive right to use, reproduce, and display AI Output generated for you, for any lawful purpose, including commercial use. You are responsible for ensuring that your use of AI Output does not infringe the rights of others or violate these Terms.
Attribution and Model Constraints: Certain integrations or models may impose attribution, usage, or sharing restrictions. Where such terms apply, they form part of these Terms and will be made available in the Service or documentation.
Feedback: If you provide ideas, suggestions, or feedback, you grant Medevc a perpetual, worldwide, irrevocable, royalty‑free license to use and incorporate them without obligation.
7. Privacy and data protection
Our Privacy Policy explains how we collect and use personal data. By using the Service, you consent to our processing of personal data as described there.
Where required by law or contract, we offer a Data Processing Addendum (DPA) for business customers upon request.
You must provide any legally required notices to, and obtain any required consents from, your end users for the use of cookies, analytics, and AI processing.
8. Subscriptions, trials, and billing
Subscriptions: Some features require a paid Subscription. Prices, features, and limits are described at checkout or in your Account.
Billing: You authorize us and our payment processors (e.g., card networks, payment gateways, or marketplaces) to charge all fees due under your Subscription and any applicable taxes.
Auto‑renewal: Subscriptions renew automatically at the then‑current price unless canceled before the end of the current term. You can cancel at any time via your Account or by contacting us.
Trials and promotions: If you sign up for a trial or promotion, we may require a payment method. Unless you cancel before the trial ends, your Subscription will convert to a paid plan and you authorize charges.
Changes to fees: We may change prices or introduce new charges by giving reasonable prior notice. Changes take effect at the start of your next billing cycle unless otherwise stated.
Refunds: Unless required by law or stated otherwise at purchase, fees are non‑refundable and partial‑period refunds are not provided. Consumer cancellation rights (if applicable) are described in Section 18.
9. Taxes
You are responsible for all taxes, duties, and similar charges imposed on your purchase or use of the Service, excluding taxes based on our net income.
10. Third‑Party Services and links
The Service may depend on or interoperate with Third‑Party Services (e.g., AI model providers, hosting, analytics, payment processors, or WordPress plugins). We are not responsible for Third‑Party Services, and they may be subject to their own terms and privacy policies.
We may replace, suspend, or discontinue access to any Third‑Party Service without liability.
11. Intellectual property
Medevc Content and the Service are owned by medevic and its licensors and are protected by intellectual property laws. Except for rights expressly granted, no license is given.
You may not remove or alter copyright, trademark, or proprietary notices.
Trademarks: Medevc's names, logos, and marks are our trademarks. You may not use them without our prior written permission.
12. Brand and publicity
We may identify you or your organization as a customer in our marketing materials and on the Site (using your name and logo) unless you opt out by emailing us.
13. Availability, maintenance, and support
We aim to keep the Service available and performant, but it may be unavailable due to maintenance, outages, or factors beyond our control.
We provide support as described on the Site or in your plan. We may communicate with you by email or within the Service.
14. Beta or preview features
We may offer beta, preview, or experimental features. They are provided "as is" without commitments and may be withdrawn at any time. Your feedback helps improve them.
15. Security
We implement reasonable technical and organizational measures to protect the Service. However, no system is perfectly secure. You are responsible for securing your devices, networks, and access credentials.
16. Disclaimers
AI limitations: AI systems can produce inaccurate or inappropriate outputs. You should not rely on AI Output as a single source of truth. Always review outputs before use.
No professional advice: Unless explicitly stated, the Service does not provide legal, medical, financial, or other professional advice.
AS IS: To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.
17. Limitation of liability
To the fullest extent permitted by law: (a) Medevc will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill; and (b) our total liability for all claims relating to the Service will not exceed the greater of (i) the amounts you paid to Medevc for the Service in the 12 months before the event giving rise to the liability; or (ii) £100. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the maximum extent permitted.
18. Consumer rights (if you are a consumer)
If you are a consumer resident in the UK or EU and purchase a Subscription online, you may have a statutory right to withdraw within 14 days of purchase. By starting to use a paid Subscription during this period, you request immediate performance and acknowledge that you may lose the right to withdraw once the service is fully performed. This section does not affect your mandatory rights.
19. Indemnity
You will indemnify and hold harmless Medevc, its affiliates, and their directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.
